The Constitution Dies Tomorrow

Blue America and Color Of Change have this ad (designed by The Seminal!) running in the front page section of the Washington Post today:

Over 200 years ago, we enshrined the rule of law as the only monarch in America. Tomorrow, the Senate will likely vote to shred that precedent. Democrats, "compromising" with Republicans, will act together, in a bipartisan fashion, to destroy your right to be free from search without a warrant. Barack Obama, the politician with the biggest megaphone out there, who said, "To be clear, [I] will support a filibuster of any bill that includes retroactive immunity for telecommunications companies," will likely miss the vote altogether, and will no doubt break his promise and fail to filibuster. And he will vote for final passage on the bill. After months of fighting, Constitutionalists everywhere will lose this battle to a corrupt establishment in collusion with a lawbreaking president.

We have no choice but to hold them accountable any way we can, through attack ads, primary challenges, and and grassroots activities. On August 8th, the new Accountability Now PAC is hosting a moneybomb to support these accountability efforts. Please mark it on your calendars and donate.

Clearly, giving money to our politicians isn't solving anything.

Youtube to hand over all user histories and IP addresses!

Google will have to turn over every record of every video watched by YouTube users, including users' names and IP addresses, to Viacom, which is suing Google for allowing clips of its copyright videos to appear on YouTube, a judge ruled Wednesday.
Viacom wants the data to prove that infringing material is more popular than user-created videos, which could be used to increase Google's liability if it is found guilty of contributory infringement.
Viacom filed suit against Google in March 2007, seeking more than $1 billion in damages for allowing users to upload clips of Viacom's copyright material. Google argues that the law provides a safe harbor for online services so long as they comply with copyright takedown requests.
Although Google argued that turning over the data would invade its users' privacy, the judge's ruling (.pdf) described that argument as "speculative" and ordered Google to turn over the logs on a set of four tera-byte hard drives.

→A List for the popular Xbox 360 games.←

The judge also turned Google's own defense of its data retention policies -- that IP addresses of computers aren't personally revealing in and of themselves, against it to justify the log dump.
The Electronic Frontier Foundation has already reacted, calling the order a violation of the Video Privacy Protection act that "threatens to expose deeply private information."
The order also requires Google to turn over copies of all videos that it has taken down for any reason.
Viacom also requested YouTube's source code, the code for identifying repeat copyright infringement uploads, copies of all videos marked private, and Google's advertising database schema.
Those requests were denied in whole, except that Google will have to turn over data about how often each private video has been watched and by how many persons.

AT&T’s Text Messages Cost $1,310 per Megabyte

atttxtxt

Price Drops on AT&T Smartphones at Amazon.com

Today is basic math day at CrunchGear where we discovered that if 160 bytes of SMS data costs twenty cents then 1MB (1,048,576 bytes) of data would cost 131,072 cents, or $1,310.72.

Check out the prices for a text message plan on AT&T, the exclusive carrier of the iPhone 3G in the United States. AT&T wants twenty cents ($0.20) per text message if you don’t sign up for a plan. A text message is nothing more than 160 bytes of data. The max is 160 characters, and one character equals one byte of data. Great.

In other words, if AT&T charged data downloads at the rate they charge text messages downloading 1MB of data would cost you $1,310.72.
